Dish, Echostar to pay USD 500 mln to settle Tivo suit
Dish Network and EchoStar have agreed to pay Tivo USD 500 million in order to settle their ongoing patent litigation. The legal battle goes back to 2004, when TiVo accused satellite TV provider EchoStar's Dish Network of violating TiVo's patent for Time Warp software that allows users to record one TV programme while watching another. Tivo has won repeated court rulings in its favour, with most recently a US federal court rejecting the latest appeal from EchoStar. The two companies agreed to pay an initial USD 300 million to Tivo, and the remaining USD 200 million in six equal annual installments between 2012 and 2017. All pending litigation between the companies will be dismissed, including the injunctions against Dish and EchoStar. As part of the deal, Dish gets a licence to Tivo's Time Warp patent and certain related patents, for the remaining life of those patents. TiVo also granted EchoStar a licence under the same patents to design and make certain DVR-enabled products solely for Dish and two international customers. EchoStar granted Tivo a licence under certain DVR-related patents for TiVo-branded, co-branded and ingredient-branded products. In addition, Tivo will play a role in helping Dish promote the Blockbuster digital video service.
