EU court rules out lower VAT rate for e-books

The EU Court of Justice has ruled that member states applying a reduced rate of VAT to books do not have to extend this to digital books. The Polish Constitutional Court, before which a case was brought by the Polish Commissioner for Civic Rights, raised the question with the EU court about whether the difference in taxation was valid. The EU Court found that a reduced VAT rate for e-books was not possible under the EU's e-commerce regulations, which aim to set standard rules for all digital services. The e-commerce legislation excludes any reduced rates for electronic services.
