Federal court returns frequency auction suit to lower court

E-Plus has had a partial success in its complaints against German telecom regulator BNA for the mobile frequency auction, which took place in the spring of 2010. The federal administrative court in Leipzig has redirected the case back to the lower court for clarification of the facts in the case. The lawsuit was filed by E-Plus against BNA for their decision about auction rules. The administrative court in Cologne dismissed the complaints and the auction took place in April and May of 2010, with E-Plus losing out on the opportunity to acquire 800 MHz licenses.
