Former EU Competition Commissioner Neelie Kroes has criticised the EC's decision that Apple should pay Ireland EUR 13 billion in unpaid taxes as 'fundamentally unfair', reports The Guardian. Kroes said that state-aid rules should not be applied to tax matters and insisted that EU members have a sovereign right to set their own tax laws. Writing in The Guardian, she also criticised the retrospective nature of the ruling, insisting that tax law changes not applying to past years was a fundamental principle of tax law.
