Tele2 wins Swedish court appeal against data retention

A court in Stockholm has upheld Tele2's appeal against the regulator PTS' order for the operator to continue with data retention for law enforcement purposes. This is in line with the ruling from the EU Court of Justice in December. The judgment of the Administrative Court of Appeal clarifies that the Swedish rules obliging operators to retain data for law enforcement purposes cannot be applied as the law is not compatible with EU law on the right to privacy, data protection and freedom of expression. The PTS confirmed that operators are no longer obliged to keep the customer data.
