UPC Poland fined PLN 33 mln for unreasonable contract conditions

Polish national competition watchdog UOKiK has imposed a PLN 32.86 million fine on cable operator UPC Poland for illegal clauses in contracts. These allowed the company to increase prices and change conditions unilaterally, without giving the customer the right to cancel at no charge. The investigation and fine follows complaints from UPC customers that the operator withdrew some channels while increasing prices.  

The decision hasn't entered into force yet, and UPC Poland has already announced that it plans an appeal. The operator said that the regulator's decision, questioning its contracts going back to 2015, "hinders market development, consumer choice and innovation, differentiating competition conditions for market players".

The watchdog outlined a number of clauses in the subscription contracts with problems. These include allowing the operator to change the channels or the price without giving a significant reason as well as arbitrarily considering a technician visit unreasonable and charging customers.
