BlackBerry has won a USD 815 million refund from Qualcomm in a binding decision from an arbitration panel over disputed royalty payments.
Qualcomm announced that it was ordered to refund a sum of USD 814.9 million, plus interest and attorneys' fees, to BlackBerry related to royalties on sales in the period 2010-2015. The companies had agreed to arbitrate a contract dispute relating to one specific issue, Qualcomm said. This was whether Qualcomm's voluntary per unit royalty cap program applied to BlackBerry's non-refundable prepayments of royalties for smartphone sales.
Qualcomm said it does not agree with the decision, but it is binding and cannot be appealed. The company said the decision would not have an impact on its agreements with any other licensee.
BlackBerry said it was pleased with the result of the arbitration and Qualcomm remains a "valued technology partner". Blackberry CEO John Chen said in a statement that the company looks forward to "collaborating with Qualcomm in security for ASICs and solutions for the automotive industry."
