Italian operators fined EUR 9 mln over consumer rights breaches

Italian competition regulator AGCM has fined Italy’s five main operators (Telecom Italia, Vodafone, Wind, Fastweb and Tiscali) a total of EUR 9 million for breaches of the consumer rights code in the area of distance marketing of both fixed and mobile telephony services. The fines mostly relate to the operators’ practice of initiating the process of activating a line or migrating from another operator during the 14-day right of withdrawal period without first seeking the customer’s permission.

The fines come after the AGCM earlier this year opened investigations into both Telecom Italia and Vodafone for suspected use of aggressive telemarketing. It even raided call centres and offices belonging to both companies with the assistance of the antitrust unit of the financial police.
