
Vivendi wins case against DeTe, Elektrim in Poland

The Warsaw Court of Appeals has denied a request from Deutsche Telekom and Elektrim to recognise an arbitral award rendered in Vienna in 2004, based on which the two operators claimed 48 percent ownership of Polish mobile operator PTC. The decision is binding and enforceable in Poland, according to Vivendi. The court decided that the arbitral award has no effect on the Vivendi subsidiary Elektrim Telekomunikacja's 48 percent ownership of PTC, confirming Vivendi's position. All of DT's and Elektrim's motions for recognition in the proceedings were rejected. After the Austrian Supreme Court, this decision marks another victory for Vivendi in its dispute with DT and Elektrim over its investment in the Polish telecom operator PTC. Vivendi claims DT and Elektrim misused the arbitral award for years as false justification to lay claim to control of those PTC shares.
