
Dutch court overturns termination rates decision

The Dutch corporate appeals court has overturned Opta's decision on mobile and fixed termination rates. The court set the mobile termination rates at 2.4 eurocents from 1 September 2012, double the rate Opta had imposed. Until then the glide path from Opta's July 2010 decision is unaffected, with a current maximum rate of 2.7 cents per minute. The court also ordered Opta to take a new decision on fixed termination rates before the start of 2012. Until then, the rates currently set by the regulator will apply, under a court injunction issued. The court also rejected Opta's market analysis that included termination of 084/087 numbers on a fixed network in the relevant market, while excluding termination of 085 numbers. OPta and the mobile operators said they will study the ruling before making any public comment.
