
ECJ confirms France Telecom state aid decision

France Telecom-Orange has failed to overturn a 2004 European Commission decision that found it in breach of state aid rules for having paid less business tax than it should have between 1994-2002. The Court of Justice of the European Union (ECJ), the highest EU court, confirmed a 2009 EU General Court decision that agreed with the EC's position. The General Court did not set a specific amount to pay back, but said the amount was between EUR 798 million and EUR 1.4 billion. France Telecom has already repaid EUR 1.02 billion.
