Ericsson faces Indian investigation over patent royalties
The Competition Commission of India (CCI) has started an investigation into Ericsson for alleged abuse of its dominant position. The investigation was prompted by a complaint from Micromax, an Indian handset market. In March, Ericsson sued the Indian company for patent infringement in Delhi High Court. Ericsson said that it made numerous attempts to sign a license agreement with the company, but Micromax claims the company was not respecting the requirement to offer fair, reasonable and non-discriminatory (FRAND) terms for licensing its patents essential to key mobile technologies. After they were unable to reach agreement, Ericsson started the lawsuit, and Micromax has now filed a complaint to the CCI as part of its general defense. The CCI has decided to refer the case to the Director General for an in-depth investigation. Ericsson said it will fully cooperate with the authority in the investigation.
