German court uses potential competition to block cable merger

A German court (Kartellsenat des Oberlandesgericht (OLG) in Duesseldorf) has overturned the takeover of Kabel Baden-Wuerttemberg (KBW) by Unitymedia/Liberty Global. The court ordered the competition regulator (Bundeskartellamt), which had approved the takeover in December 2011, to reassess the case. This marks a victory for Deutsche Telekom and NetCologne; they had appealed against the regulatory decision, saying the concessions imposed did not go far enough. The court sill needs to publish the full motivation of its ruling. The companies have a month from the ruling on 14 August to file an
