Without regulation, peering market will fail and OTT sector suffer

Net neutrality remains a well-intentioned concern throughout Europe and the US. In the US, a recent court ruling means that the regulator cannot impose net neutrality obligations. The FCC lost the case on procedural grounds, as broadband is defined as an information service, not a telecom service, in the US, meaning the regulator has no control over the sector. Comcast is still subject to a limited form of net neutrality (see below), under the conditions of regulatory approval for its takeover of NBC Universal a few years ago.
