3 UK loses appeal against 5G spectrum rules

The UK's High Court has rejected 3 UK's legal challenge to the rules around the upcoming 5G spectrum auction, ISPreview reported. 3 UK wanted the regulator to impose a 30 percent spectrum cap in order to stop EE (BT) from participating. Ofcom reasoned that EE should be allowed to bid on 3.4 GHz frequencies because the extra spectrum is necessary for MNOs to launch 5G services. Preventing access to this spectrum would damage their ability to compete with early 5G deployments, Ofcom believes. EE filed its own suit to stop 3 UK's legal challenge and cap.
