ACM rejects KPN appeal over EUR 2 mln fine

The ACM has upheld a fine of EUR 2 million against KPN over SDF backhaul services in the period 2009-2012. The fine first announced in June 2015 was for violations of KPN's non-discrimination requirements and a ban on margin squeezes. The ACM found that KPN was charging its own operations less for services than wholesale customers. The regulator said it did not matter whether SDF access was actually taken in a specific form by customers such as Tele2. KPN's appeal on the fine was rejected, but another appeal, against a fine of EUR 6 million over ISDN lines announced at the same time, is still
