Apple wins patent suit against Samsung in The Hague
A court in The Hague has ruled that Samsung infringed a patent held by Apple for a technique to swipe through a gallery of photos. Smartphones and tablets with Android 2.2.1 or higher but without the 'blue flash functionality' are in violation of the patent EP868. Devices with Android 3.0 are not subject to the order as the swipe is executed in a different way. A Dutch court earlier issued a preliminary injunction against sales of the Samsung Galaxy S, S II and Ace models in the Netherlands. Samsung must now have an independent accountant calculate the net profits earned on sales of the devices, under threat of fines. Apple will use the amount to determine damages. The ruling applies only for Samsung Benelux, and not the other companies charged by Apple.
