Arcep sides with Bouygues in dispute with SFR over wholesale fibre price increases

France’s telecom authority Arcep has ruled in favour of Bouygues Telecom in a dispute between the operator and SFR FTTH, which was triggered by wholesale price increases enforced by the Altice France subsidiary earlier this year. Bouygues Telecom took the decision to resolve the matter through mediation in late January. SFR FTTH also faces a similar dispute over its wholesale price rises from Iliad’s Free, with Arcep confirming to the French press that this separate mediation procedure is underway.

Bouygues Telecom had asked Arcep to reverse two price changes made by SFR FTTH in the so-called ‘SFMD’ areas, where FTTH network deployments are governed by the AMII agreement (generally concerning mid-size towns) and by AMEL contracts (mainly covering rural communities).

SFR FTTH was accused of breaching Arcep’s guiding principles and enforcing an unreasonable price rise to its co-financing rates, effective from 01 February. Bouygues Telecom had also demanded a decrease in the monthly passive line rental fee set at EUR 16.40 per line (excluding VAT), arguing instead for a range of between EUR 12.20 and EUR 13.20.

After assessing the co-financing rates, Arcep concluded that the price increase was neither justified nor reasonable, and ruled in favour of a restoration of the previous rates. On the passive line rental fee, the regulator sided with Bouygues Telecom and reached the decision that a price of EUR 13.20 was reasonable.
