BoF loses appeal against T-Mobile Netherlands zero-rated offering

T-Mobile NL launched its Datavrije Muziek offering in October 2016. Under the deal, users can stream unlimited music with no additional costs for mobile internet. ACM lost its case to ban the offer and said it would not appeal the decision. The Dutch government had tried to impose a strict ban on zero-rating, but the EU regulation on net neutrality "without a doubt" does not include such a categorical ban on price discrimination, the judge said. BoF appealed that decision in May 2018.
