Brazil Court bans local company from using iPhone brand

Brazil's Superior Court of Justice (STJ) has banned IGB Eletronica, owner of local smartphone brand Gradiente, from using the term 'iphone' in Brazil, a trademark that is exclusive to Apple. The STH dismissed an appeal filed by IGB Eletronica and the National Institute of Industrial Property (INPI), which sought to obtain exclusivity of use of the iphone trademark in Brazil. However, the company may continue to use the G Gradiente Iphone trademark, which it registered.
