Dutch court scraps near-net requirement for wholesale fibre

KPN and Eurofiber have won their appeal against the ACM's decision on regulation of the business fibre market. The corporate appeals court has scrapped a key element of the regulation, the so-called near-net requirement. This would have required KPN to extend its fibre network to new addresses if a wholesale customer so requested. The 'near-net' condition would have applied for any site within 250m of the existing network route, a demand KPN and Eurofiber found too burdensome.
