EC told to reassess Telefonica and Portugal Telecom fines

The General Court of the EU has dismissed the appeals lodged by Telefonica and Portugal Telecom (PT) against the fines handed down by the European Commission for their illegal non-competition clause relating to the Spanish group's acquisition of Brazilian operator Vivo. However, the EU's highest court agreed with the view of PT and Telefonica that the EC was not obliged to undertake a detailed analysis of the structure of the markets concerned and of potential competition between companies on those markets in order to conclude that the clause constituted a restriction of competition by
