French court annuls decree on refarmed spectrum licence fee

France's highest administrative court, the Conseil d'Etat, has annulled a March 2013 decree which steeply increased the licence fees for refarming Bouygues Telecom's 1800 MHz spectrum from 2G to 4G. The court did not take issue with the principle of increasing the licence fee, but agreed with the operator's claims that it should not have been based on 15 years because the spectrum had been allocated four years earlier, in 2009, and that it should not have been calculated on the economic advantage of using it exclusively for 4G as it continued to use it for 2G as well.
