
The German Federal Office of Justice (BfJ) has imposed a fine of EUR 2 million on Facebook for failing to list all the complaints concerning illegal content in its transparency report for the first half year of 2018.
The incomplete report is incompatible with the Network Enforcement Act (NetzDG). According to the law, Facebook must file a report every six months in German on how it handles complaints about illegal content. It must publish this report in the Federal Gazette as well as on its own homepage.
However, Facebook’s Transparency Report July for 2018 was found to be inadequate in terms of several statutory information requirements, the Federal Office of Justice said in a statement. The report lists only a fraction of complaints about illegal content. In addition, Facebook is accused of having made an incorrect report regarding the feedback received on the complaints.
Facebook can appeal against the decision by the Federal Office of Justice.
