German court refers Google dispute with telecoms regulator to ECJ

A court in Germany has referred a years-long dispute between Google and Germany's national telecoms regulator, the Federal Network Agency, over the legal status of Google's Gmail service to the European Court of Justice (ECJ) for clarification. The ECJ was asked whether webmail services like Google's Gmail, which are rendered via the internet without actually providing customers with an internet connection, should legally be classified as telecommunications services and thus fall under the Federal Network Agency's remit, said the Higher Administrative Court (OVG) in Muenster.
