German govt says platforms will find it hard to avoid upload filters in EU copyright reform

The German Justice Secretary Christian Lange said that online platforms will not be able to circumvent the use of upload filters for content generated by users, because of the strict liability regime, Heise Online reports.  

Algorithm-based means are already used in cases of large data volume, but manual measures are not excludef, particularly in the case of complaints from users, the government added.  

Steffen Siebert, spokesperson for the government, said that the EU guidelines on the copyright reform do not prescribe an upload filter.  A spokesperson for the Justice Ministry said that automatic identification systems have not been explicitly mentioned and are therefore only a possibility. 

German Federal Justice Minister Katarina Barley has said already that the so-called upload filter is a necessary tool to introduce under the EU copyright reform. Barely said that the filter is the only technical means to "prevent licence infringements".  

Germany has recently seen a series of protests in cities including Leipzig and Magdeburg against the reform of the copyright law at European level. Protesters fear that the upload filter will mean a restriction of the freedom of expression online.
