German high court orders enforcement of ban on Facebook collecting data without consent

The German Federal Court of Justice has ruled that the decision of the Federal Cartel Office, Bundeskartellamt, to prohibit Facebook from processing users' data without their consent can be enforced. The Bundeskartellamt believes Facebook abuses its dominant position through its terms of use, and violates Section 19 (1) of the GWB competition law. The Court said in its ruling that the terms of use leave private Facebook users with no say in whether they want to use the social network by customising the service more, which potentially means unlimited access by Facebook to so-called
