Mexican Supreme Court decision delays Telefonica spectrum fees claim

Friday 9 November 2018 | 14:10 CET | News
Mexico’s Supreme Court has refrained from ruling on a claim for some MXN 7.9 billion (around USD 400 million) in compensation for spectrum fees from Telefonica’s local unit, deciding to return the injunction to a lower court for judgment, reports local daily El Universal. The ruling by the first chamber of the SCJN on Telefonica’s appeal against article 244-A of the Federal Rights Law could delay or derail the operator’s chances of recovering the fees paid out for the 700MHz band, said the report.

Telefonica argued that the recently-activated ‘Red Compartida’ wholesale 4G shared network received unlawful preferential treatment on spectrum rights and the Finance Ministry should reimburse the spectrum payments it made in 2016, 2017 and 2018, while applying a MXN 2.6 billion reduction in licence fees payable as of 2019.
