Supreme Court dismisses Telefonica appeal against wholesale fixed broadband rules

Spain's Supreme Court has dismissed Telefonica's appeal against the wholesale fixed broadband regulation introduced by telecommunications watchdog CNMC back in 2016. The most controversial aspect of the wide-ranging regulation was that requiring Telefonica to provide wholesale access to its fibre-optic network in all of Spain apart from 66 cities deemed "competitive" by the watchdog. The former incumbent challenged various aspects of the rules, above all the CNMC's geographical segmentation criteria.
