Tele2 appeal on FTTH wholesale rates rejected

The Dutch corporate appeals court (CBb) has rejected Tele2's appeal against the unbundled FTTH tariff decision of 2012, according to regulator ACM. The decision sets the maximum rates for wholesale access to KPN's fibre network, based on KPN's operating costs. Tele2 felt the tariffs were too high and would limit investment and competition. The latest decision is based on a similar one for the period 2009-11, with an inflation correction. The earlier decision (WPC-IIa) is still subject to appeal by KPN as well as alternative operators BT, Colt, Verizon Business, Bbned, Online and Tele2.
