
A complaint lodged over the matter with communications regulator CNMC in February has gone unanswered, the company's director of legal and regulatory affairs, Pedro Pena told a news conference.
Allowing its rivals wholesale access to premium digital content, including the two sports, was one of the conditions attached to Telefonica’s takeover of pay-TV platform Digital+ last year. Under the conditions set by CNMC, Vodafone and Orange were notably allowed to choose the content of the wholesale packages purchased from Telefonica to ensure they could replicate the market leader's offer.
According to Pena, Vodafone requested access to Formula 1 and MotoGP content in January but was told it would have to wait until Telefonica renews its wholesale tariffs in July, mid-way through the season for both sports.
He said Vodafone contacted CNMC on 23 February to report Telefonica for failing to comply with the conditions of the Digital+ takeover but has had no reply and is therefore considering legal action.
Expansion did not say if it had contacted Telefonica or the regulator for comment.
