WhatsApp loses appeal over Dutch data protection compliance

WhatsApp has lost an appeal against a decision by the Dutch data protection regulator ordering the company to appoint a representative for the Netherlands to manage compliance with the Law on personal data protection. If the company does not comply with the order, it faces a fine of EUR 10,000 per day, up to a maximum EUR 1 million. The court found that WhatsApp processes information of Dutch users from Dutch smartphones, meaning it must comply with the local data protection rules and cannot claim it only transfers data without processing.
