
Apple to refund customers, clarify 4G claim

Apple has provided an undertaking in response to the urgent application filed by the Australian Competition and Consumer Commission (ACCC) over Apple's marketing of new iPad as '4G'. The ACCC said the promotion of the "iPad with WiFi + 4G" by Apple is misleading because it represents to Australian consumers that the product can connect to a 4G mobile data network in Australia, when this is not the case. Apple has said that it will display a statement that says "This product supports very fast cellular networks. It is not compatible with current Australian 4G LTE networks and WiMAX Networks" in its promotional materials, website, and online store. The company will also distribute signage to resellers with the same statement and e-mail customers for whom Apple has an e-mail address with the information and an offer for a refund. The measures must be implemented before 5 April. A mediation has been ordered for 18 April and a hearing on liability has been set down commencing 2 May.
