
The US International Trade Commission has issued a preliminary ruling on Finnish phonemaker Nokia’s May 2012 patent infringement lawsuit against Taiwanese rival HTC.
The ITC ruled in Nokia’s favour in two of the three patents-in-suit, on a “method and arrangement for transmitting and receiving RF signals through various radio interfaces of communication systems” and a “method for attenuating spurious signals and receiver”. The ITC found no infringement regarding the third patent in question, on a "method for making a data transmission connection from a computer to a mobile communication network for transmission of analogue and/or digital signals.
Foss Patents explains that these are not standard-essential patents and that although HTC holds a licence to Nokia's SEPs, it does not hold a licence to Nokia's non-SEPs. Both parties have the right to appeal the ITC decision. HTC could decide to license the patents rather than pursue further litigation. Nokia said it would reserve further comment until it has had the chance to study the judgement in detail.
