OpenTV files patent suit against Netflix in the Netherlands
OpenTV, a Kudelski Group company, filed a lawsuit against Netflix in the District Court of The Hague, Netherlands alleging that Netflix infringes its patents and is seeking, among other relief, to enjoin Netflix from further infringement by its recently launched service in the Netherlands. The Kudelski Group is a specialist in digital television and set-top box security technologies and counts more than 100 pay-TV service providers worldwide among its customers.

This is the world's first ruling over a dispute about whether OTT service providers should pay internet service companies for network usage, The Korea Economic Daily reports. Dutch court rejects OpenTV patent claim against Netflix

A court in The Hague has rejected a patent infringement claim against Netflix brought by OpenTV, Computerworld reports. OpenTV claimed that Netflix was infringing its Dutch patent from 2003 on linked media services. The court found that an older patent had strong similarities with OpenTV's patent, meaning it did not meet the criteria of novelty and inventiveness. All the claims, including a ban on Netflix and damages, were rejected.

Netflix in Nederland onderwerp patentengeschil

Netflix is in Nederland aangeklaagd wegens de schending van enkele DRM-patenten van OpenTV, dat in handen is van de Kudelski Group. Volgens het bedrijf maakt de videodienst zich schuldig aan het onrechtmatig gebruik van software die ook door OpenTV wordt gebruikt. De Kudelski Group, een Zwitsers technologiebedrijf, klaagde Netflix eerder al aan in de Verenigde Staten. Netflix ging begin vorige maand van start in Nederland.
