
Virnetx has won a final court ruling worth USD 439.7 million in its long-running patent infringement suit against Apple. The US District Court for East Texas rejected Apple's final motions at the end of September, and in early October the companies agreed on the payment amount.
A year ago Virnetx was awarded USD 302.4 million in damages in an initial ruling. In its latest ruling, the court granted all of Virnetx's motions and increased the royalty rate for a period of willful infringement by 50 percent, from USD 1.20 to USD 1.80 per device. This results in total damages due by Apple of USD 343.7 million. With interest and legal fees, the total amount rises to USD 439.7 million.
The final judgement is only subject to appeal stemming from new issues unresolved in the first Apple case, remanded back from the US Court of Appeals for the Federal Circuit.
Virnetx said it was pleased with the judgement and that the jury's initial royalty rate of USD 1.20 per infringing iPhone, iPad and Mac was upheld. "We believe this established per device rate for security is very reasonable and will greatly assist us with our domestic and global licensing efforts," the company added.
