Huawei wins injunction against Motorola, NSN deal
Huawei Technologies has won a court order preventing Motorola Solutions from transferring the Chinese company's intellectual property in the sale of the Motorola networks business to Nokia Siemens Networks. The District Court for the Northern District of Illinois issued a preliminary injunction in favor of Huawei that prevents Motorola from transferring Huawei's confidential information to Nokia Siemens Networks. The order also requires Motorola to hire a qualified third-party to ensure Huawei's confidential information is securely removed, and also allows Huawei to audit NSN's record of service it performs on Motorola-branded systems that include Huawei products. Huawei sued last month, arguing that Motorola's deal would illegally transfer Huawei's trade secrets to a competitor. Motorola had access to Huawei IP as a longtime reseller of the Chinese company's products. Motorola noted the judge didn't expressly forbid the sale of any assets, just the transfer of Huawei secrets, and said the deal should still close by the end of the first quarter. The company also said it will protect Huawei's confidential information.
