Regulator rejects complaints against Telefonica fibre deals

Spain's competition regulator CNMC has rejected complaints filed by Vodafone and Orange against Telefonica's bundling of free TV content in Movistar Fusion fibre deals, reports Europa Press. In separate complaints filed at the start and end of May, Orange and Vodafone alleged that the incumbent operator was abusing its position in Spain to reduce competition in the telecoms sector by offering deals – namely Movistar Fusion Fibre at 10 Mbps and 100 Mbps with Movistar TV – that couldn't be replicated by rival operators.

However, the regulator has proceeded to shelve the complaints on the grounds that Telefonica’s convergent deals could indeed be replicated by alternative operators without incurring in losses. The CNMC added that access to audiovisual content is not currently regulated, meaning that alternative operators were in a position to create attractive offers to compete with Telefonica’s convergent packages.
