Samsung to postpone launch of Galaxy Tab 10.1 in Australia
Samsung has agreed to postpone the launch of its Galaxy Tab 10.1 tablet until the last week of September, reports The Australian. The hold-up was agreed at an interlocutory hearing before Justice Annabelle Bennett in the federal court in Sydney. The court has not issued an injunction against the sale of the Galaxy Tab 10.1, and the court did not make any ruling during the hearing. Samsung lawyer David Catterns told the court he believed the device did not infringe on any of the patents cited by Apple in its application to the court. After Samsung's agreement, Justice Bennett did not extend the injunction forbidding Samsung from selling its tablet and from advertising the device. Samsung will file an undertaking that it would not launch the tablet until the last week of September and gave an undertaking to Apple that it would give 48 hours notice of any pending launch of the tablet. A hearing has been set for the last week of September at which time Justice Bennett said there would either be a judgement or a new agreement on the Samsung tablet's distribution. Samsung said it was filing a cross-claim, citing a number of alleged infringements of its tablet by Apple's iPad tablet. The intended Australian action follows legal action taken by Samsung against Apple for patent infringement in the US, Germany, Korea and other countries. Samsung said it would continue to defend its right to launch the Tab in Australia so that consumers had a wider selection of products to choose from.
