3 Austria CEO confirms appeal of spectrum auction
Hutchison Drei Austria (3 Austria) has confirmed plans to file an appeal against the results of the recent mobile spectrum auction. This follows a similar announcement by rival T-Mobile Austria. CEO Jan Trionow said the structure and content of the auction was illegal and highly damaging to his company. He is especially critical of the "non-transparent rules" and the "disproportionate auction design". The company will file complaints with the Administrative Court and the Constitutional Court.

The Austrian Constitutional Court has declined to issue an injunction that would let mobile operators delay paying EUR 2 billion for the spectrum they won at the auction in September. Telekom Austria will not file an appeal against the recent mobile spectrum auction. Company spokesperson Peter Schiefer told Austrian newspaper 'Die Presse' that it had decided not to appeal so as not to threaten the roll-out of its LTE network. Rivals T-Mobile Austria and 3 Austria have both confirmed their plans to appeal.
