German court rejects last-minute injunction against 5G auction

The German administrative court of Cologne has rejected the appeals for an injunction against the 5G auction, DPA reports. The appeals were filed by Deutsche Telekom, Vodafone, Telefonica Germany and Freenet. The judge said that there is no urgency for such as court order, as the rules set by the Federal Network Agency are lawful. The main proceeding of the operators' lawsuits against the 5G licence conditions will likely start in a few months. 

A spokesperson for Telefonica said that even after the end of a trial, an auction could be reversed. The representatives of the political parties welcomed the decision of the administrative court. It is positive that the framework conditions have been clarified and the auction can start, said Ulrich Lange, vice-head of the CDU/CSU group in the parliament. 

The vice-head of the FDP party Frank Sitta said that Germany, as an attractive country for businesses, could not have afforded a delay of the auction. The auction for the 5G frequencies will start on 19 March.
