Mexico’s supreme court has ruled that America Movil’s fixed-line unit Telmex should not be prohibited from charging rivals interconnection fees. The decision comes after the company in August prevailed in another of its injunctions against the 2014 telecommunications reform, opening the way for mobile unit Telcel to once again begin charging its rivals for use of its network three years after the reform imposed a zero interconnection rate. The country’s telecommunications watchdog IFT has been entrusted with setting Telmex’s corresponding tariffs starting 01 January 2019 just as it has already done with Telcel’s rates.
Last month the IFT approved a plan to separate part of America Movil’s fixed-line units into new companies as part of anti-trust measures against the company and with a view to opening up its infrastructure to competitors Telmex, which has around 62 percent of Mexico’s fixed-lines, now has two years to carry out the functional separation of its retail and wholesale fixed-line businesses.
