Dutch court overturns law requiring wholesale cable offer

A court in The Hague has overturned Dutch legislation requiring cable operators to resell their analogue TV services to other providers. The two largest cable operators, Ziggo and UPC, had appealed the changes to the Media and Telecommunications Acts. The smaller operator Zeelandnet supported the appeal, while Tele2 sided with the start in support of the legislation. The court found that the requirement was in violation of EU rules, which do not allow parliament to impose such a general requirement. Furthermore the required wholesale offer is not expected to significantly improve competition
